The company reserves the right to update these regulations at any time, at its sole discretion. These terms apply to the use of our website and its services across all devices, including mobile phones, tablets, and other communication tools. They govern your use of the website, whether through the internet or any other network or communication medium. Nothing in these regulations is intended to detract from the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: "Consumer Protection Law") and its accompanying regulations, where applicable to our website. Exceptions apply only where such provisions can be explicitly or implicitly waived within the website's framework. While the company and website management strive to provide the most complete and comprehensive product information, including images, we clarify that occasional inaccuracies, errors, or omissions may appear on the website in good faith, without malicious intent or a desire to mislead. The company, website management, and the website will not be held liable for any inaccuracies or errors. Chapter headings are provided solely for your convenience and orientation and should not be used in the interpretation of these regulations. Clerical errors in product descriptions will not obligate the company. Product images on our website are for illustrative purposes only. Please note that there may be differences in appearance, shade, size, and other characteristics between the product as displayed on the website and the actual product. You may not copy, reproduce, distribute, sell, market, rent, or translate any information from the website, including trademarks, images, texts, product design, product images, etc., without the company's prior written approval. The date recorded in the company's computers shall be the conclusive date for all purposes.
Registration for the Website
To place an order for products, you must register on our website using the online registration form. Anyone, including a company, may use the website and make purchases through it, provided they are legally capable of entering into binding agreements and possess a valid credit card issued by an approved credit card company (hereinafter: "the customer"). Registration is a one-time process. Once registered, you will not need to re-register for subsequent purchases. During registration, you will need to enter a username, password, and your email address. If you forget your password, the existing password, as initially entered during registration, will be sent to the email address provided. For future purchases, you will be identified by your chosen username and password. Your details will be updated based on the information you provide in the online registration form available on the website. The website management may occasionally request additional identification details. Without limiting the foregoing, the company reserves the right to temporarily or permanently prevent anyone from using the website at its sole discretion and without prior notice, including in any of the following circumstances:- Engaging in illegal activity or violating legal provisions.
- Breaching any of the terms of these regulations.
- Intentionally providing incorrect information.
- Performing actions that could disrupt the proper functioning of the website, its suppliers, or any third party.
- If your credit card has been blocked or its use restricted in any way.
Purchasing Products on the Website
To purchase products, add them to your shopping cart. After adding items, you will be prompted to enter the following customer details in the online form during the order process: first name, last name, phone number, and email address. You will also need to provide the recipient's details: first name, last name, phone number, locality, street, house number, floor, apartment, entrance, and any other identifying information that can assist the delivery person in easily locating the property for order delivery, including notes and information regarding the shipping process or if the recipient is not at home. Fields marked with an asterisk are mandatory, and without them, the order cannot be completed. To prevent any delivery issues, please provide only accurate and correct information. Upon completing your order, you will be asked to confirm the order details and the accuracy of the information you have provided. Providing all requested details is a prerequisite for efficient and error-free order processing. Therefore, it is essential to ensure all details are submitted accurately. Your details will be updated according to the information provided in the online order form on the website. Once all required product purchase details are submitted, it will be considered an order (hereinafter: "the Order"). Upon receipt of the order, the website will verify your credit card details. Only after approval from the credit card company and/or after receiving approval from PayPal, as explained below, will the transaction be confirmed, and a final order confirmation issued. You will be charged for the product via your credit card and/or PayPal account, as explained below, subject to product availability in the company's and the website's inventory. The details you provide in the order form will serve as conclusive evidence of the correctness of the operations.Method of Payment for the Order
Payment for products can be made via credit card or through an "electronic wallet" service, such as PayPal (WWW.PAYPAL.COM), or any similar service made available on the website from time to time at the discretion of the website management. If you choose to pay by credit card, you will be asked to provide your credit card details, identification number, card type, and expiration date. If you choose to pay via PayPal, the company will only collect payment for the products after receiving approval from PayPal. The use and approval process through PayPal are subject to PayPal's terms of use. The website management reserves the right to discontinue the use of any payment method on the website, to permit the use of additional payment methods, and to apply different payment arrangements for various credit card types or other payment methods honored by the website management. After entering your payment details in the online order form, you will receive an email confirmation that your order details have been received. Please note that this confirmation does not obligate the website management to supply the ordered products; it merely indicates that your order details have been successfully recorded by the website management. Immediately after the order is placed, the website management will verify the payment method you used. A suitable notification will be issued to confirm the order, and your account will be charged for the service cost. Should the transaction not be approved by the credit card company, PayPal account, or any other payment method available at that time, you will receive a corresponding notification. The website management will then contact you to finalize or cancel the transaction. Confirmation of the purchase transaction is contingent upon the purchased product being in stock at the requested delivery time and/or at the time of order. If the product is not explicitly marked as out of stock and has not been removed from the website by the time the order is placed, the website management will not be obligated, provided that the website management refunds any amount paid to the customer, if applicable, and/or cancels the charge made for the purchase. It is clarified that there may be situations where, despite an item being shown as in stock on the website, it is actually unavailable and cannot be supplied. In such cases, the transaction will be canceled, and the customer will have no claim in connection with this, subject to the refund of the amount paid by the customer. The shipping date will be determined from the day the transaction is approved by the credit card company or upon approval from the PayPal account or any other approved electronic wallet service. If you are mistakenly charged by the credit card company, please notify the website management immediately to process a credit.Supply and Transportation of Products
Product delivery by the website will only occur after receiving payment approval from the credit card company and/or from the PayPal account, meaning the product has been paid for, as detailed above. The product will be delivered to the address you entered and/or provided when placing the order via the online form. The website is committed to delivering the goods within the specified delivery timeframe to the requested destination and will make every effort to ensure the product arrives quickly. The website management will make every effort to deliver the products promptly: within 14 business days from the date of order receipt and approval if sent via registered mail, and within 3 business days if sent via courier. Product delivery times are calculated based on business days only (Sunday to Thursday, excluding Fridays, Saturdays, holiday eves, and holidays). Deliveries handled by the shipping company on behalf of the website management are subject to the shipping company's terms, its distribution areas, and require prior coordination with the order recipient. Should the shipping company be unable to deliver to the shipping address for any reason, the website management will inform you and work to find an alternative solution agreeable to both parties. In cases where products are delivered via Israel Post to the shipping address you provided when placing the order, the products will be dispatched subject to Israel Post's delivery times, which are beyond the control of the website management and/or suppliers. The delivery times stated on the website and above do not apply to products that are out of stock on the website and/or from the relevant supplier. Shipments are carried out by a courier company, which will perform the transportation of the products. The terms of the courier company will be binding on the customer. Shipping Fees: In addition to the price of the ordered products, you will be charged shipping fees. The amount of the shipping fees will be displayed at the end of the ordering process, according to the shipping method you selected, unless otherwise stated. Shipping fees will be paid along with the payment for the product. For installment sales via credit card and/or PayPal account, the website may collect the shipping fees with the first payment. The website will not be responsible for any delay, postponement, or non-delivery of products caused by any of the following reasons:- Force majeure: Including, but not limited to, war, military operations, emergency operations, natural disasters, or events beyond the website's control, such as general economic strikes and shutdowns, or issues with suppliers of services or goods essential for product manufacturing, supply, or transportation.
- Any reason not within the control of the website and/or the company.
- A reason related to the delivery operator.
Cancellation of Purchase by the Customer
You may cancel a transaction in accordance with the provisions of the Consumer Protection Law and its enacted regulations. Without derogating from the foregoing:- Cancellations must be made via written notice to the email address fbnoffice@gmail.com or by calling 054-6636884.
- Cancellation of a transaction by the customer will not be possible for the purchase of certain items as detailed in sub-section 14c(d) of the Consumer Protection Law.
- Cancellation of the transaction by the customer is contingent on the product being returned, to the extent reasonable or possible, in its original packaging.
Cancellation of Purchase by the Company
The Company reserves the right, at its sole discretion, for any reason, and at any time, to cancel or discontinue a transaction and/or sale and/or cancel an order, in whole or in part, and/or the website's activity, in whole or in part. Notice of such cancellation or discontinuation will be provided to the user or customer. The company will refrain from charging your credit card or will refund any amount already paid for the products, if applicable. Except for the refund of the transaction amount as stated, the user or customer will have no claim, demand, and/or lawsuit against the company and/or the supplier due to the cancellation of the transaction as stated in this section. Should a product be discovered to be out of stock, the website reserves the right to cancel the order or offer an equivalent alternative item. If an order is canceled as described, the website will not be responsible or liable for any direct, indirect, consequential, or special damages incurred by the customer or a third party, including, but not limited to, damages related to purchasing the item from a third party at a higher price.Copyright

It is strictly forbidden to copy, reproduce, distribute, sell, market, rent, or translate any information from the website, including trademarks, images, texts, product design, product images, etc., without obtaining prior written approval from the Company. You may not link to content on the website that is not the website's homepage (deep linking), nor may you display or publish such content in any way, unless the deep link leads to the website's web page in its entirety and as it appears, allowing for viewing and use identical to that on the website, and only with the consent of the website management. The website management reserves the right to order the cancellation of a deep link even after granting its consent, at its sole discretion. In such an event, you will have no claim, demand, or lawsuit against the website management.Responsibility
The Company (and/or anyone on its behalf) bears no direct or indirect responsibility for damages arising from and/or related in any way to the repair, assembly, and/or replacement of the products. The Company (and/or anyone acting on its behalf) bears no direct or indirect responsibility for damages resulting from the use of and/or reliance on information published on external websites accessible through any of the services on our site. It is clarified that the Company strives to cooperate only with reliable and reputable suppliers. The Company (and/or anyone on its behalf) bears no direct or indirect responsibility for damages arising from and/or related in any way to the use and/or performance of the website. In any event, the Company will not be held responsible for any activity of any other entity that is not under its full control.Confidentiality and Privacy
All your personal details (name, email, etc.) will be stored in the Company's databases. The Company will not transfer your personal details to any other entity except to suppliers, as needed, and only for the purpose of completing a transaction. The Company will not make any use of your payment method details except for processing payment for a transaction you wished to conduct, and these details will not be transferred to any other entity except for this purpose. For clarification, payment method details are not stored in the Company's databases. Notwithstanding the above, the Company reserves the right to transfer a user's personal details to a third party in cases where you have committed an act or omission that harms or may harm the Company and/or any third parties, or if you have used the Company's services to perform an illegal act. This also applies if the Company receives a judicial order instructing it to provide your details to a third party, as well as in any dispute or legal proceedings. The Company may use your personal details, without identifying you specifically, for the purpose of statistical data analysis and its presentation and/or disclosure to other parties. As operations are conducted in an online environment, the Company cannot guarantee absolute immunity from intrusions into its computers or the exposure of stored information by those carrying out illegal activities. Should a third party succeed in accessing or misusing information stored by the Company, you will have no claim, demand, or lawsuit against the Company. The Company reserves the right to use "cookies" to provide you with a fast and efficient service and to save you the need to re-enter your personal details each time you visit the website. In circumstances beyond the Company's control and/or arising from force majeure, the Company shall not be liable for any damage of any kind, whether indirect or direct, that may be caused to you and/or anyone on your behalf if this information is lost or used without authorization.Law and Jurisdiction
The law applicable to these regulations and/or to any action and/or to any dispute arising therefrom, is Israeli law only. In the event of any dispute, the courts of Tel Aviv-Jaffa (Magistrate's Court or District Court) shall have exclusive jurisdiction. החברה והנהלת האתר עושים כמיטב יכולתם להציג את המידע השלם והמקיף ביותר לגבי המוצר לרבות תמונות, חרף האמור בסעיף זה יובהר, כי עלולים
להופיע באתר בתום לב וללא כוונת זדון ו/או מתוך רצון להטעות, אי דיוקים ו/או שגיאות ו/או השמטות והחברה, הנהלת האתר והאתר לא יישאו באחריות כלשהי הנובעת
מאי הדיוקים ו/או או השגיאות. -
כותרות הפרקים מובאות לשם נוחות והתמצאות המזמין ולא ישמשו בפרשנות התקנון.

טעות סופר בתיאור מוצר/ים לא תחייב את החברה.

תמונות המוצרים באתר מוצגות לצורכי המחשה בלבד. בנוסף, ייתכנו הבדלים במראה, בגוון, בגודל, וכיו”ב בין המוצר, כפי שהוא מוצג באתר, לבין המוצר במציאות.

אין להעתיק ולהשתמש, או לאפשר לאחרים להשתמש, בכל דרך אחרת בתכנים מתוך האתר, לרבות באתרי אינטרנט אחרים, בפרסומים אלקטרוניים,

הרשמה לאתר

על מנת לבצע הזמנה של מוצרים על המזמין להירשם באתר באמצעות טופס הרשמה מקוון.

כל אדם, לרבות חברה, רשאי להשתמש באתר, לרבות לבצע רכישות באמצעות האתר, בין היתר, בכפוף להיותו כשיר לבצע פעולות משפטיות מחייבות,
, בעל כרטיס אשראי תקף ,שהונפק ע”י אחת מחברות כרטיסי האשראי (לעיל ולהלן: “המזמין”). -
הרישום הינו חד פעמי, כאשר לאחריו המזמין לא יידרש לשוב ולהירשם בכל פעם מחדש בעת ביצוע הרכישה.

בעת הרישום באתר על המזמין להזין שם משתמש וסיסמא וכן את כתובת הדואר האלקטרוני שלו. במידה וישכח המזמין את הסיסמא, תשלח אליו הסיסמא
הקיימת כפי שהוזנה בעת הרישום הראשוני באתר לכתובת הדוא”ל אשר הוזנה באתר. -
בעתיד אם וכאשר יבקש המזמין לרכוש מוצרים נוספים, יזוהה המזמין לפי שם המזמין והסיסמא שבחר.

פרטי המזמין יעודכנו בהתאם לנתונים אשר ימולאו על ידי המזמין בטופס הרישום המקוון במצוי באתר.

הנהלת האתר רשאית מעת לעת לדרוש פרטי זיהוי נוספים.

מבלי לגרוע מהאמור לעיל, החברה תהא רשאית למנוע מכל אדם להשתמש באתר, באופן זמני או לצמיתות על פי שיקול דעתה הבלעדי ומבלי למסור
הודעה על כך מראש, לרבות בכל אחד מהמקרים הבאים:-
ביצוע מעשה בלתי חוקי ו/או הפרת הוראות הדין;

הפרת תנאי מתנאי תקנון זה;

מסירת פרטים שגויים במתכוון;

ביצוע פעולה העלולה לפגוע בפעילותו התקינה של האתר ו/או במי מהספקים ו/או בצד ג’ כלשהו;

כרטיס האשראי שברשות המזמין נחסם או הוגבל לשימוש בדרך כלשהי.

רכישת מוצרים באתר
-
רכישת המוצרים תתבצע באמצעות הוספת מוצרים לסל הקניות, לאחר הוספת מוצרים לסל הקניות יזין המזמין בטופס המקוון המיועד לכך בתהליך
ההזמנה את פרטי המזמין הבאים: שם פרטי, שם משפחה, מס’ טלפון, כתובת דואר אלקטרוני, בנוסף יש למסור את פרטי מקבל ההזמנה, שם פרטי,
שם משפחה, מס’ טלפון, יישוב, רחוב מס’ בית, קומה, דירה, כניסה וכל פרט מזהה אחר שיש בידיו לסייע למבצע המשלוח לאתר בקלות את הנכס אליו מתבצעת
מסירת ההזמנה לרבות הערות ומידע בנוגע לפעולת השילוח ו/או במידה ומקבל ההזמנה אינו בבית. השדות המסומנים בכוכבית קיימת חובה למלאם ובלעדיהם לא תתאפשר
השלמת ההזמנה. -
על מנת למנוע כל אפשרות של תקלה במשלוח על המזמין למסור רק פרטים מדויקים ונכונים.

בעת פעולת השלמת ההזמנה יאשר המזמין את פרטי ההזמנה ואת נכונות הפרטים שמסר.

מילוי כל הפרטים מהווה תנאי מוקדם לביצוע ההזמנה וזאת לשם ביצוע ההזמנה ביעילות וללא תקלות ועל כן יש להקפיד על מסירת כל הפרטים במדויק.

פרטי המזמין יעודכנו בהתאם לאמור בטופס ההזמנה המקוון באתר.

מילוי כל הפרטים הנדרשים לרכישת המוצר על ידי המזמין יחשב לביצוע הזמנה (להלן:”ההזמנה”) עם קבלת ההזמנה, האתר יבצע בדיקה של פרטי כרטיס האשראי
ורק לאחר אישור חברת האשראי ו/או לאחר קבלת אישור מפיי פאל כפי שיובהר להלן, הפעולה תאושר ויצא אישור סופי של ההזמנה, חיוב הלקוח עבור המוצר יבוצע
דרך כרטיס האשראי ו/או דרך חשבון הפיי פאל כפי שיבואר להלן והכל בכפוף להימצאות המוצרים במלאי החברה והאתר. -
הפרטים כפי שהוזנו בטופס ההזמנה על ידי המזמין, יהוו ראיה חלוטה לנכונות הפעולות.

אופן ביצוע התשלום עבור ההזמנה

התשלום עבור המוצרים יעשה באמצעות כרטיס אשראי או באמצעות חשבון בשירות “ארנק אלקטרוני” כדוגמת פיי פאל- (WWW.PAYPAL.COM) וכל שירות דומה
, כפי שיהיה זמין לשימוש באתר, מעת לעת לפי שיקול דעתה של הנהלת האתר. -
אם יבחר המזמין להשתמש בכרטיס אשראי לשם ביצוע התשלום, יתבקש המזמין למסור את פרטי כרטיס האשראי, תעודת זהות, סוג הכרטיס ותוקפו. אם החליט המזמין לשלם באמצעות הפיי פאל, החברה תוכל לגבות את התשלום עבור המוצרים רק לאחר קבלת אישור מפיי פאל. השימוש וקבלת האישור מפיי-פאל כפופים לתנאי השימוש של אתר פיי פאל.

הנהלת האתר שומרת לעצמה את הזכות להפסיק את השימוש באמצעי התשלום כלשהו באתר, להתיר שימוש באמצעי תשלום נוספים ולהחיל הסדרי תשלום שונים על סוגי כרטיסי אשראי שונים או אמצעי תשלום שהנהלת האתר תכבד.

לאחר שהוזנו פרטי התשלום בטופס ההזמנה המקוון, ישלח אל המזמין אישור באמצעות הדואר האלקטרוני על קליטת פרטי ההזמנה. יובהר כי אישור זה אינו מחייב את הנהלת האתר לספק את המוצרים שהוזמנו והוא רק מעיד שפרטי ההזמנה נקלטו בהנהלת האתר.

מיד לאחר ביצוע ההזמנה, תבצע הנהלת האתר בדיקה של אמצעי התשלום בו השתמש המזמין, תינתן הודעה מתאימה למזמין כי ההזמנה אושרה וחשבונו יחויב בעלות השירות.

במקרה בו לא אושרה העסקה על ידי חברת האשראי או על ידי חשבון הפיי פאל או כל אמצעי תשלום אר שיהיה באותה עת, יקבל המזמין הודעה מתאימה על כך והנהלת האתר תיצור קשר עם המזמין לשם השלמת העסקה או ביטולה.

אישור פעולת הרכישה מותנה בהימצאות המוצר הנרכש במלאי במועד האספקה המבוקש ו/במועד ההזמנה. אם לא צויין, כי המוצר אינו קיים במלאי והמוצר לא הורד מהאתר עד למועד ביצוע ההזמנה, לא תהא הנהלת האתר מחויבת בכפוף לכך שהנהלת האתר תשיב למזמין כל סכום ששולם אם שולם להנהלת האתר ו/או תבטל את החיוב אם בוצע בגין פעולת הרכישה.

יובהר כי יתכנו מצבים בהם על אף שהפריט מוצג באתר כקיים במלאי, בפועל הוא חסר ולא ניתן לספק אותו, במקרים אלו תבוטל העסקה ולמזמין לא תהה כל טענה בקשר לכך בכפוף להשבת הסכום ששולם על ידי הלקוח.

מועד המשלוח יקבע החל מיום אישור העסקה על ידי חברת האשראי או אישור מחשבון הפיי פאל או שירות ארנק אלקטרוני זמין אחר שאושר.

במידה והמזמין חויב בטעות על ידי חברת האשראי, על המזמין להודיע להנהלת האתר על מנת לבצע זיכוי בהתאם.

אספקה והובלת המוצרים
-
אספקת המוצר ע”י האתר יעשה רק לאחר קבלת אישור תשלום מאת חברת האשראי ו/או מאת חשבון הפיי פאל, כלומר המוצר שולם, כמפורט לעיל, המוצר יסופק לכתובת שהמזמין הקליד ו/או מסר בעת ביצוע ההזמנה בטופס המקוון.

האתר מתחייב לספק את הסחורה במסגרת זמן האספקה ליעד המבוקש ויעשה כמיטב יכולתו כי המוצר יגיע במהירות.

הנהלת האתר תפעל כמיטב יכולתה לספק את המוצרים במהירות והמוצרים ובתוך 14 ימי עסקים מיום קליטת ההזמנה ואישורה אם נשלח באמצעות דואר רשום ותוך 3 ימי עסקים אם נשלח באמצעות שליח.
זמני אספקת המוצרים כוללים רק את חישובם של ימי עסקים (ימי א’ עד ה’, לא כולל ימי שישי, שבת, ערבי חג וימי חג). -
המשלוחים שיסופקו באמצעות חברת המשלוחים מטעם הנהלת האתר הינם בהתאם לתנאי חברת המשלוחים, אזורי החלוקה של חברת המשלוחים ובתאום מראש עם מקבל ההזמנה.

במידה ואין ביכולתה של חברת המשלוחים לבצע את המשלוח עד לכתובת המשלוח מכל סיבה שהיא. הנהלת האתר תודיע למזמין ותפעל למציאת פתרון חלופי אשר יענה לרצון שני הצדדים.

במקרים בהם מסופקים המוצרים באמצעות דואר ישראל, לכתובת המשלוח שמסר המזמין בעת ביצוע ההזמנה. המוצרים יישלחו בכפוף לזמן האספקה של דואר ישראל ואינם ניתנים לבקרה ולשליטה על ידי הנהלת האתר ו/או הספקים.

מועדי האספקה המצוינים באתר ולעיל אינם חלים על מוצרים שאזלו מן המלאי של האתר ו/או מן המלאי של הספק הרלוונטי.

המשלוחים מבוצעים על ידי חברת שליחויות, באמצעותה תבוצע ההובלה של המוצרים תנאי חברת השליחויות יחייבו את הלקוח.

דמי המשלוח – בנוסף למחיר המוצרים שהוזמנו, יושת על המזמין תשלום של דמי משלוח, סכום דמי המשלוח יופיע בתום תהליך ההזמנה בהתאם לדרך השילוח אותה בחר המזמין, אלא אם כן צויין אחרת.

דמי המשלוח ישולמו עם התשלום בגין המוצר. במכירה בתשלומים באמצעות בכרטיס אשראי ו/או באמצעות חשבון הפיי פאל. האתר רשאי לגבות את דמי המשלוח עם חיוב התשלום הראשון.

האתר לא יהיה אחראי לכל איחור ו/או עיכוב באספקה ו/או לאי אספקה של המוצרים אשר נגרם כתוצאה מאחת הסיבות להלן:

כח עליון ומבלי לפגוע בכלליות האמור מלחמה, מבצע צבאי, מבצע חרום ו/או נזקי טבע ו/או מאירועים שאינם בשליטת האתר כגון שביתות והשבתות כלל משקיות ו/או אצל ספקים של שירותים או סחורות הדרושים לייצור אספקה או הובלת מוצר.

כל סיבה שאינה בשליטת האתר ו/או החברה.

מסיבה הקשורה עם מבצע השליחות.

זמני אספקת המוצרים המצוינים כוללים רק את חישובם של ימי עסקים (ימי א’ עד ה’ לא כולל ימי שישי ושבת, ערבי חג וימי חג).

על הלקוח להודיע מיידית לאתר אם המוצר לא סופק בתקופת האספקה המפורטת באתר, במקרה כזה זמן האספקה החדש ייחשב מיום תיאום מועד חדש.

יש להקפיד למלא פרטים מדויקים ועדכניים, במקרה שהמוצרים יחזרו לחברה בגלל פרטים מוטעים, המזמין יישא בתשלום בגין דמי משלוח וטיפול.

ביטול רכישה מצד המזמין

המזמין רשאי לבטל את העסקה בהתאם להוראות חוק הגנת הצרכן והתקנות שהותקנו על פיו. מבלי לגרוע מהאמור:

ביטול ייעשה בהודעה בכתב לכתובת הדוא”ל fbnoffice@gmail.com או בטלפון טלפון: 054-6636884

ביטול עסקה ע”י המזמין לא יתאפשר ברכישת פריטים מסוימים כמפורט בסעיף קטן 14ג(ד) לחוק הגנת הצרכן.

ביטול העסקה ע”י הלקוח כפוף לכך שהמוצר יוחזר ככל שהדבר סביר או אפשרי באריזתו המקורית.

לאחר קבלת הודעת הביטול יושב למזמין הסכום ששולם על ידו בגין המוצר בניכוי דמי ביטול (דמי המשלוח אינם חלק ממחיר המוצר ולכן ינוכו בנפרד מההחזר) בשיעור של 5% מסכום העסקה או 100 ש”ח, לפי הנמוך. במקרה של ביטול עסקה עקב פגם או אי התאמה, לא יחויב המזמין בדמי ביטול כלשהם. הוראות חוק הגנת הצרכן נוספות בנוגע לביטול הרכישה מצד המזמין, לרבות בנוגע לחובה להחזיר המוצר, יחולו גם-כן.

ביטול רכישה מצד החברה

החברה תהא רשאית, על פי שיקול דעתה הבלעדי, בשל כל סיבה, ובכל עת, לבטל או להפסיק עסקה ו/או מכירה ו/או לבטל הזמנה, כולה או חלקה, ו/או את פעילות האתר, כולו או חלקו.

הודעה על ביטול או הפסקה מעין זה תימסר למשתמש או למזמין, והחברה תימנע מחיוב כרטיס האשראי של המזמין או תשיב לו כל סכום ששולם בגין המוצרים, ככל ששולם.

למעט בגין השבת סכום העסקה כאמור, לא תהיה למשתמש או למזמין כל טענה, תביעה ו/או דרישה כלפי החברה ו/או הספק בגין ביטול העסקה כאמור בסעיף זה.

במידה והתגלה כי מוצר אזל מהמלאי, רשאי האתר לבטל את ההזמנה או להציע פריט חלופי שווה ערך. בוטלה הזמנה כאמור האתר לא יהיה אחראי ולא ישא בכל נזק ישיר, עקיף, תוצאתי או מיוחד שנגרם ללקוח או לצד שלישי לרבות אך לא רק נזק בגין רכישת הפריט אצל צד שלישי במחיר גבוה יותר.

זכויות יוצרים

כל זכויות הקניין הרוחני, לרבות פטנטים, זכויות היוצרים, הדגמים, המדגמים והסודות המסחריים, הנם רכושם של החברה בלבד או של צדדים שלישיים אחרים שהרשו להנהלת האתר להשתמש בהם.

זכויות אלה חלות בין השאר על הנתונים באתר, לרבות רשימת המוצרים, תאור ועיצוב המוצרים וכל פרט אחר הקשור להפעלתו.

זכויות אלה חלות גם על שם האתר, סימני המסחר (בין אם נרשמו ובין אם לא) הם כולם רכושה של החברה. אין לעשות בהם שימוש בלא קבלת הסכמתה בכתב ומראש.

אין להעתיק, לשכפל, להפיץ, למכור, לשווק, להשכיר ולתרגם מידע כלשהו מהאתר, לרבות סימני מסחר, תמונות וטקסטים, עיצוב המוצרים תמונות המוצרים וכיו”ב בלא קבלת אישור מראש ובכתב של החברה.

אין לקשר לתכנים מהאתר, שאינם דף הבית של האתר (קישור עמוק) ואין להציג או לפרסם תכנים כאמור בכל דרך שהיא, אלא אם הקישור העמוק יהיה לדף האינטרנט באתר במלוא וכפי שהוא, כך שניתן יהיה לצפות ולהשתמש בו באופן הזהה לחלוטין לשימוש ולצפייה בו באתר וזאת תוך קבלת ההסכמה מהנהלת האתר.

הנהלת האתר רשאית להורות על ביטול של קישור עמוק גם לאחר מתן הסכמתה וזאת לפי שיקול דעתה הבלעדי ובמקרב זה לא תהיה לך כל טענה ו/או דרישה ו/או תביעה כלפי הנהלת האתר.

אחריות

החברה (ו/או מי מטעמה) אינה נושאת במישרין ו/או בעקיפין באחריות כלשהי לנזקים הנובעים ו/או הקשורים בכל דרך שהיא, על תיקונם, הרכבתם ו/או החלפתם של המוצרים.

החברה (ו/או מי מטעמה) אינה נושאת במישרין או בעקיפין באחריות כלשהי לנזקים הנובעים כתוצאה משימוש ו/או הסתמכות על מידע המתפרסם באתרים חיצוניים, שאליהם ניתן להגיע באמצעות איזה מהשירותים באתר. יובהר כי החברה עושה ותעשה כמיטב יכולתה לשתף פעולה עם ספקים אמינים ובעלי מוניטין בלבד.

החברה (ו/או מי מטעמה) אינה נושאת במישרין ו/או בעקיפין באחריות כלשהי לנזקים הנובעים ו/או הקשורים בכל דרך שהיא בשימוש ו/או בביצועי האתר.

בכל מקרה החברה לא תישא באחריות לפעילות כלשהי של כל גורם אחר שאינו בשליטתה המלאה.

סודיות ופרטיות

כל פרטיו האישים של המזמין (שם, דואר אלקטרוני וכדומה), יישמרו במאגרי המידע של החברה.

החברה לא תעביר פרטיו האישיים של המזמין לאף גורם אחר זולת לספקים, במידת הצורך וזאת רק לשם השלמת עסקה.

החברה לא תעשה כל שימוש בפרטים של אמצעי התשלום של המזמין אלא לביצוע תשלום בגין עסקה אותה ביקש המזמין לערוך, ופרטים אלו לא יועברו לאף גורם אחר זולת לצורך זה. למען הסר ספק, פרטי אמצעי התשלום אינם נשמרים במאגרי המידע של החברה.

למרות האמור לעיל, החברה תהא רשאית להעביר פרטיו האישיים של משתמש לצד שלישי במקרים בהם המזמין ביצע מעשה או מחדל הפוגעים ו/או העלולים לפגוע בחברה ו/או בצדדים שלישיים כלשהם, המזמין עשה שימוש בשירותי החברה לביצוע מעשה בלתי חוקי, אם התקבל בידי החברה צו שיפוטי המורה לה למסור את פרטי המזמין לצד שלישי וכן בכל מחלוקת או הליכים משפטיים.

החברה תוכל להשתמש בפרטיו האישיים של המזמין, ללא זיהוי המזמין הספציפי, לצורך ניתוח מידע סטטיסטי והצגתו ו/או מסירתו לגורמים אחרים.

מאחר שמדובר בביצוע פעולות בסביבה מקוונת אין באפשרותה של החברה להבטיח חסינות מוחלטת מפני חדירות למחשביה או חשיפת המידע האגור בידי מבצעי פעולות בלתי חוקיות. אם יעלה בידי צד שלישי לחדור למידע אשר שמור בידי החברה ו/או להשתמש בו לרעה, לא תהיה למשתמש כל טענה, תביעה או דרישה כלפי החברה.

החברה תהא רשאית לעשות שימוש ב – “עוגיות” (“cookies”) על מנת לספק למשתמש שירות מהיר ויעיל ולחסוך מהמזמין הצורך להזין את פרטיו האישיים בכל כניסה לאתר.

בקיום מקרים שאינם בשליטתה של החברה ו/או הנובעים מכח עליון, החברה לא תהא אחראית לכל נזק מכל סוג שהוא, עקיף או ישיר, שייגרם למזמין ו/או למי מטעם המזמין עם מידע זה יאבד או אם יעשה בו שימוש לא מורשה.

דין ושיפוט

הדין החל על תקנון זה ו/או על כל פעולה ו/או על סכסוך הנובע ממנו, הוא הדין הישראלי בלבד.

בכל מקרה של מחלוקת, תהא לבתי המשפט (השלום או המחוזי) תל אביב-יפו הסמכות הבלעדית לדון בה.

הדין החל על השימוש באתר, על ההזמנה ועל תקנון זה, לרבות פרשנותו ואכיפתו של התקנון הוא הדין הישראלי בלבד.
